(A) The Contest

The Contest requires participants to “Guess the Location” by mentioning the name of the Location in the comment section with hashtag #kohlerguessthelocation for the during of the Guess the Location campaign. This Contest is organized by Kohler East Africa Corporation Limited (“Kohler”). By participating in this Contest, you declare that you are eligible to participate and agree to be bound by these Terms and Conditions (T&C’s), which shall form a valid and binding between you and Kohler.

(B) Eligibility

This Contest is open to persons who, as on 11^th  November 2024 are at least eighteen (18) years and persons who are legally authorized to participate in such contests.

(C) Mechanics of the Contest “Guess the Location Campaign”

• By participating in this Contest, you consent to have read the T&Cs and agree to abide by all sets of conditions in the program/event.
• Participating in the contest does not guarantee your selection as a winner
• Kohler will, in its sole and absolute discretion, pick up the randomly selected entries of the Contest as winners from the specific participating regions by Kohler and will contact the participants for more details.
• The decision of Kohler regarding the winners and all matters relating to or in connection with this Contest these T&C’s of the event is/are final and binding. Kohler shall not be obliged to enter any correspondence on any matter concerning the Contest. For any disputes, both parties i.e., the Company and the participant hereby irrevocably admit themselves to and consent to the jurisdiction of the competent court of Nairobi, Kenya only for all matters related to the said Contest.

Launch Invitation

• This invitation is valid from 11^th November 2024 as mentioned on the invitation
• The invitation is not transferrable and/or exchangeable in kind or cash or otherwise
• Winners will be invited to participate in the showroom launch event at the venue decided upon by Kohler. By participating in the event, you are hereby granting Kohler permission to use the shared personally identifiable information for purposes and in connection with promotional activities (without additional compensation) unless prohibited by law. Participants /guests are expected to understand/read and adhere to the instructions and guidelines (whether in oral or written form) as suggested by the Kohler associates/event organizer
• Kohler reserves the right to final admission and Kohler reserves the right to select a reserve participant to replace any winner subsequently disqualified.
• Kohler may without the requirement of any notice and without liability to any party may vary these T&C’s or discontinue the Contest or substitute, withdraw/cancel any prize without disclosing any reason and without any payment or compensation whatsoever.
• By participating in the Contest, all participants agree to release and hold harmless Kohler (along with its agents/organizing agency) from any and all liability whatsoever for any injuries, losses or damages of any kind to any person or property arising from or in connection, either directly or indirectly, with the awarding, acceptance, receipt, possession, use or misuse of any of the Prize or part thereof awarded pursuant to the Contest or any Prize-related activities including without limitation, any error in computing or malfunctioning of any computer system etc.
• Kohler makes no warranty or representation as to the quality, merchantability, or fitness for purpose of the merchants’ goods and services, distributed as prizes (if any). Any dispute about the same must be resolved directly with the merchant. Merchant’s standard terms and conditions shall apply in accordance.
• In the event of any inconsistency between these T&C’s and any brochure, marketing or promotional material relating to the Contest, these T&C’s will prevail.
